Tenn. high court to hear Vanderbilt rape records appeal
The Tennessee Supreme Court has agreed to hear an appeal by The Tennessean and other media groups over access to records in the rape case against four former Vanderbilt football players.(Photo: Larry McCormack / File / The Tennessean)The Tennessee Supreme Court has agreed to hear an appeal by The Tennessean and other media groups over access to records in the rape case against four former Vanderbilt football players.The trial for two of the players accused in the alleged rape of a 21-year-old woman in a campus dorm in June 2013 is underway in downtown Nashville. Two other former players also face charges in the case.The Tennessean, eight media organizations and the Tennessee Coalition for Open Government filed suit against Metro Nashville government last fall seeking access to records in the case that were not created by government entities but were in the hands of police — records including text messages between Vanderbilt football coaches and players.Davidson County Chancellor Russell Perkins ruled in March that some records given to police should be made available. However, Perkins stopped short of releasing the files because of other outstanding questions that went before an appeals court.In September, the Court of Appeals ruled the records should not be released because they were part of an ongoing police investigation.On Friday, the state Supreme Court agreed to the hear the media coalition's appeal.Lawyers for the media coalition will have 30 days to file a brief before the Supreme Court, and Metro attorneys will have 30 days to respond before the court hears the case.The four former players — Brandon Vandenburg, Cory Batey, Brandon Banks and Jaborian McKenzie — have each been charged with five counts of aggravated rape and two counts of aggravated sexual battery.
